Using Original Court Records: A Hands-On Workshop
September 20, 2008 -- 1 p.m.

Charles A. Sherrill, M.A., M.L.S., Presenter

In this two-part session participants will gain hands-on experience in identifying and interpreting original records.  Exercises using copies from 19th-century minute books, dockets, estate packets and court cases will help develop skills for effective research among these records.

First Hour

The Creation of Court Records

  • Typical courts of record found in each state
  • Distinguishing between law and equity courts
  • Record-keeping process followed by clerks
  • Types of ledgers commonly found
  • Docket and Minute Book Exercise

  • Class examines sample documents
  • Identifies type and court of origin
  • Searches for answers to questions posed by instructor
  • Group discussion
  • Probate Records Exercise

    Following discussion of probate process and documents created:
  • Class examines sample records of estate inventory
  • Estate sale report
  • Guardian’s report and administrator’s bond
  • Searches for answers to questions posed by instructor
  • Group discussion
  • Second

    Hour

    Law Court Case File Exercise

    Following discussion of types of cases heard in law courts and the types of bound and loose records:
  • Class examines two sample pages from assault case file
  • Searches for answers to questions posed by instructor
  • Group discussion
  • Equity Courts Discussion

  • Outline types of cases heard in equity courts
  • Discuss information found in bound volumes vs. loose records
  • Detail 12 types of documents commonly found in equity case packets
  • Equity Case File Exercise

  • Class examines 10 sample pages from equity dispute case file
  • Identifies type of document
  • Searches for answers to questions posed by instructor
  • Group discussion

  • This workshop includes a 30-page handout packet
